CEO Wheelie Challenge Terms and Conditions

This page sets out the Terms and Conditions regarding:
Participating in the CEO Wheelie Challenge (including any associated fundraising) (the Event); and
The Privacy Notice in relation to the Sporting Wheelies’ CEO Wheelie Challenge website (the Website).

(Collectively, the Terms and Conditions).

Please note that Sporting Wheelies reserves the right to change the Terms and Conditions without notification to you and you should periodically visit this page to review the Term and Conditions.

Sporting Wheelies may remove any content posted by you, prevent access by you to the Website and/or prevent you from participating in the Event if you do not comply with these Terms and Conditions. The Term and Conditions are subject to the laws of Australia.

The Website is owned and operated by Spinal Life Australia, who are the owners of Sporting Wheelies. Your access to the Website and participation in the Event is conditional upon your acceptance of, agreement to and compliance with the Terms and Conditions, notices and disclaimers, including the Website’s Privacy Notice.

By accessing the Website and/or registering for the Event, you are deemed to have read and are bound to the unconditional acceptance and compliance with the Terms and Conditions set out below.

Information contained on the Website is as up to date as our resources permit and has been provided as complete and in good faith without any express or implied warranty. Sporting Wheelies is not liable for any costs or losses you incur through your use of the Website (including by accessing links to third party websites from the Website).

WEBSITE TERMS AND CONDITIONS

All logos and slogans are subject to copyright obligations to Sporting Wheelies and, along with all information, text, graphics, advertisements, audio and multimedia found on this Website (in whole or in part) are not to be copied, reproduced, reused, reposted, repurposed, transmitted, adapted, republished, broadcast, distributed or uploaded without written authorised permission.

The information on the Website has been provided for personal, non-commercial use only, to provide information on the services provided by Sporting Wheelies.

EVENT TERM AND CONDITIONS

CEO Wheelie Challenge 2024 (the Event)

The Event is hosted by Spinal Life Australia, who are the owners of Sporting Wheelies, and is intended to raise money and awareness about accessibility and inclusiveness for people with a disability by encouraging participants to use a wheelchair for one day.

In entering the Event, you agree to the following terms and conditions:

  1. I have volunteered at my sole risk to raise funds for Spinal Life Australia (ABN 39 293 063 049) by undertaking an activity which may be personally challenging for me.
  2. As soon as possible after the Event, I will remit to Spinal Life Australia all funds I have raised along with photographs and other documentation of the Event for use by Sporting Wheelies in future fundraising activities including promoting future CEO Wheelie Challenge events.
  3. I understand and acknowledge that:
    1. The Event may involve an inherent risk.
    2. No representation or warranties in relation to my safety and the safety of the event including the CEO Wheelie Challenge is being made by Sporting Wheelies or any of the Event organisers
    3. I will properly consider any risks before undertaking the Event.
    4. The decision to participate in the Event is entirely my own and I accept and assume all risks and liabilities associated with participation in the Event, including but not limited to loss of life or permanent injury.
    5. I will comply with the reasonable directions of Sporting Wheelies and its authorised representatives and that Sporting Wheelies may remove me from the Event at its sole discretion.
  4. In consideration of and as a condition of acceptance of my participation in the Event for myself, my heirs, executors and administrators, I:
    1. Waive, release and discharge you (including its directors, staff, agents and independent contractors, the Event providers, volunteers and sponsors (the “Indemnified Parties”), from all and any liability including all claims or causes of action which I might otherwise have (including for negligence) arising from any injury, loss, or damage of whatever kind suffered or sustained by me arising or indirectly out of my participation in the Event; and
    2. Indemnify the Indemnified Parties against any claim, action, liability, loss, damage, cost or expense that the Indemnified Parties incur or are liable for as a result of my participation in the Event including my participation in the Event; and
    3. Agree not to bring any claim against Sporting Wheelies or any third party involved in the Event including but not limited to the Event providers for loss or damages, regardless of whether negligence can be demonstrated.
  5. I acknowledge that Sporting Wheelies will not insure me or my employer in relation to any aspect of the Event and I agree that I am responsible for all necessary insurance to cover my participation in the Event.
  6. I agree to abide by all laws relating to the conduct of the Event and any advice or rules of any third party involved in the Event including the Event organisers.
  7. I warrant that I am physically fit to participate in the Event and I will not participate in the Event if I am currently suffering from any medical or other condition that may impair or impede my ability to participate.
  8. I consent to receive medical treatment which may be deemed advisable in the event of injury, accident and/or illness during the Event.
  9. I am at least eighteen (18) years old.
  10. I consent to the use of any or all of my name, image, job title and employer details, voice and statement and any photographs supplied under clause 2 above to promote the Event in any form of media without payment or compensation. If you do not wish your involvement to be promoted, or for photos or footage of you to be used, please make this known to the Event team upon registration.
  11. I have had the opportunity to review the Spinal Life Australia Privacy Notice below.
  12. The Event is a ‘dry’ event and absolutely no alcohol will be allowed while using the wheelchairs.

Privacy Notice

Spinal Life Australia and Sporting Wheelies understand the importance of protecting your privacy and complywith the Australian Privacy Principles and the Privacy Act 1988.

We collect your personal information via the Website to register you as a participant in the Event and for the purpose of issuing you with a valid tax invoice. We may also disclose your personal information for fundraising and marketing purposes, such as sending you details about other activities, special offers or promotions by Sporting Wheelies.

If you are receiving promotional information from us and do not wish to receive this information any longer, please contact us at corporate@sportingwheelies.org.au asking to be removed from our mailing lists or use the unsubscribe facilities included in any of our marketing or communications.

Changes to our Policy

Please be aware that we may change this Privacy Notice from time to time in the future. The revised versions will be uploaded onto our Website; so please check back from time to time. If, at any point, we decide to use personal information in a manner materially different from that stated at the time it was collected we will notify you by email or via a prominent notice on our Website, and where necessary we will seek your prior consent.
